A judge has cited the crime-fraud exception to attorney-client privilege in ordering a lawyer to testify about work he performed for a group of stock-fraud defendants. The ruling stems from an investor suit charging that Defense Technology Systems' stock was used in a "pump and dump" scheme. Judge Shira Scheindlin said the attorney's deposition testimony provided adequate probable cause to believe that the attorney-client communications at issue were intended to facilitate or conceal criminal activity.
